Terms of Use
These Terms of Use ("Terms") govern your access to and use of the Ninja Communications website, sales funnel, and SMS program. Use of our paid services is governed separately by the Customer Service Agreement you execute with us.
1. Acceptance of terms
These Terms form a binding agreement between you and Ninja Communications LLC ("Ninja Communications", "we", "us", or "our"). By accessing ninjacomms.io, submitting a form, or opting in to receive SMS from us, you accept these Terms. If you are using the site on behalf of a business, you represent that you are authorized to bind that business to these Terms.
2. Eligibility
You must be at least 18 years old and legally able to enter into contracts to use this site or our SMS program. The site and services are directed to U.S. businesses — primarily credit repair organizations ("CROs") — and are not intended for use by consumers of those CROs directly unless their CRO has authorized it.
3. The services
Ninja Communications offers information about our business process outsourcing (BPO) and call center services on ninjacomms.io, a qualifying sales funnel, and scheduling for discovery calls. Nothing on the site is an offer or a contract for paid services. Paid engagements begin only after you execute our Customer Service Agreement and, where applicable, complete payment.
4. Accounts & accuracy
When you submit information through our website or SMS program, you agree to provide accurate, current, and complete information, and to keep it up to date. You are responsible for the security of any credentials we issue you and for all activity that occurs under your account.
5. SMS program & A2P 10DLC
Ninja Communications operates an A2P 10DLC-registered SMS program through a U.S. wireless carrier aggregator. By providing your phone number to us through a web form, survey, phone call, or text, or by replying START / YES / JOIN to one of our messages, you provide prior express written consent under the Telephone Consumer Protection Act (TCPA) to receive SMS messages from Ninja Communications at the mobile number you provided, including messages sent via automatic telephone dialing systems.
Program details
- Message types: transactional (appointment confirmations, discovery-call reminders, onboarding nudges, service updates) and — where you specifically opt in — promotional.
- Message frequency: varies by program. Typical maximum is 8 messages per month per user.
- Cost: Message and data rates may apply. Check with your wireless carrier.
- Supported carriers: all major U.S. carriers including AT&T, T-Mobile, Verizon, Sprint, U.S. Cellular, Cricket, MetroPCS, Boost, and their MVNOs. Carriers are not liable for delayed or undelivered messages.
Opting out & help
- Reply STOP to any Ninja Communications SMS to unsubscribe from that program.
- Reply HELP to any Ninja Communications SMS to receive help and contact information.
- You can also email privacy@ninjacomms.io to be removed from all Ninja Communications SMS lists.
Confidentiality of SMS opt-in data
Ninja Communications does not share, sell, rent, or disclose mobile numbers, SMS opt-in data, or SMS message content to any third party or affiliate for their own marketing or promotional purposes. See our Privacy Policy for full details on how we handle this information.
Consent to receive marketing SMS is not a condition of any purchase. You may revoke consent at any time as described above. Ninja Communications reserves the right to terminate the SMS program or your participation in it at any time without notice.
6. Acceptable use
You agree not to:
- Use the site or SMS program for any unlawful purpose or in violation of these Terms, the TCPA, CAN-SPAM, CROA, state consumer-protection laws, or carrier rules.
- Submit false, misleading, or other people's information through our forms, or impersonate another person or business.
- Attempt to gain unauthorized access to the site, our servers, or accounts of other users.
- Introduce viruses, malware, or other harmful code; scrape the site with automated tools; or interfere with its normal operation.
- Copy, reproduce, republish, or redistribute any content from the site without our written permission.
- Use SMS replies to harass, threaten, or spam Ninja Communications staff or agents.
7. Intellectual property
The Ninja Communications name, logo, wordmark, "NINJACOMMS", "Sí, hablamos español" trade-dress, website content, copy, graphics, and underlying code are owned by or licensed to Ninja Communications LLC and are protected by U.S. and international intellectual-property laws. Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to view the site for your own business evaluation. All other rights are reserved.
8. Third-party links & services
The site and SMS program may link to or integrate with third-party services (for example, calendar booking through GoHighLevel / LeadConnector, payments through Stripe, or SMS delivery through a carrier aggregator). We do not control those services and are not responsible for their content, availability, or practices. Your use of those services is governed by their own terms and privacy policies.
9. Disclaimers
The site and the SMS program are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. Ninja Communications makes no guarantees about specific business results, revenue outcomes, or the effectiveness of any call-handling, language, CMI-recovery, or progress-update strategy described on the site.
Any testimonials, case studies, or performance figures shown on the site reflect specific engagements and are not a guarantee of the results you will experience.
10. Limitation of liability
To the fullest extent permitted by law, Ninja Communications, its affiliates, officers, employees, and agents are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, goodwill, or data, arising from or relating to your use of the site or the SMS program, even if advised of the possibility of such damages.
Ninja Communications' total aggregate liability under these Terms for any and all claims relating to use of the site or the SMS program is limited to the greater of (a) the amount you paid to Ninja Communications for access in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100).
Nothing in these Terms limits liability that cannot be excluded or limited under applicable law.
11. Indemnification
You agree to defend, indemnify, and hold harmless Ninja Communications and its affiliates, officers, employees, and agents from and against any claim, liability, damage, loss, or expense (including reasonable attorneys' fees) arising out of or relating to (a) your breach of these Terms, (b) your misuse of the site or SMS program, (c) your violation of any law or the rights of any third party, or (d) information you submit through the site that is inaccurate, unauthorized, or infringes on another's rights.
12. Termination
We may suspend or terminate your access to the site or SMS program at any time, with or without notice, for any reason — including if we believe you have violated these Terms. Upon termination, the provisions of these Terms that by their nature should survive (Sections 7, 9, 10, 11, 13) will continue in effect.
13. Governing law & arbitration
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or your use of the site or SMS program will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules, seated in Dallas County, Texas, and conducted in English.
You and Ninja Communications each waive the right to a trial by jury and the right to participate in a class action or class arbitration. Claims must be brought in an individual capacity only.
If any part of this Section 13 is held unenforceable, the remaining parts will continue to apply, and any non-arbitrable claim will be resolved in the state or federal courts located in Dallas County, Texas, to whose jurisdiction you and Ninja Communications consent.
14. Changes
We may update these Terms from time to time. Material changes will be reflected in the "Last updated" date at the top of this page and, where appropriate, announced on the site. Your continued use of the site or SMS program after a change means you accept the updated Terms.
